dead on illinois avenue near bay road and university. officers went there after someone called about shots fired. paramedics pronounced the victim dead at the scene. witnesses say the gunman got out of the car and walked up to banford before 9:00 last night. shot him several times, then went back to the car and took off. east palo alto police are asking witnesses to call them with any information. >> this morning crews are searching waters near coyote point in the san francisco bay for a missing 62-year-old wind surfer. she's been gone for more than 12 hours. christie smith is live at yorba buena island with an update. good morning. >> reporter: good morning. in the last minute or so spokesperson for the u.s. coast guard arrived here at yorba buena island, she's trying to give a press conference and update us on the search for this missing 62-year-old wind surfer. we know her name is kathy katan

out of los altos. she is experienced. here with us this morning is heather and good morning. can you tell us what's new this morning? what are you going to do? >> there's nothing too new that we haven't discussed last night. as we stated last evening, around 7:20 we got a call, the coast guard, that kathy was missing. she is a 62-year-old woman out of los altos. she was told her husband around 5:00 she was going to go wind surfing for 30 minutes. he reported her missing, overdue, around 6:30. and then notified the coast guard. we've had been on scene. we searched 82 square miles in the vicinity of foster city up to san mateo bridge. we are continuing our search this morning at first light. alameda county has been out since last night. and all of the other resources for san mateo county plan on doing a first light search as

well. >> how's the water? are the waves taking her out to the ocean or she should be in that area where she was? >> she should be in the area where she went missing. the waves are very calm right now, the water temperature is about 70 degrees in san mateo and 65 degrees in alameda county so her survival rate is pretty good right now with the water temperatures and the sea conditions. it's not too foggy so we've had great searching conditions overnight as well. >> why has it been so difficult? >> it's difficult because we have not found any evidence of her missing yet. she is wearing a black wet suit, has blue helmet on, she has an orange wind surfing board with a red sail, so if anybody sees anybody matching this description, definitely call the coast guard. >> because it was dark did it make it harder or were there plenty of lights to spot her if she were in that area? >> we have plenty of lights on the helicopter and the vessels but this also gives mariners a great reminder to always carry

flares, wear proper pfd with reflective material and a great idea to have electronic positioning device on you as well so if something like this happens we're able to track you faster. >> is there a regular area for her? is she used to going out here? >> she was. she is a strong swimmer, avid wind surfer. she went in for a break and was going out again. she knew what she was doing, very experienced. >> does -- >> she has a vhs radio. we have not had calls from it so we're not able to use our rescue 21 asset to locate her. >> thank you so much for updating us. that's what we have from here. that's the latest from here reporting live on yorba buena island, christie smith. i'll toss it back over to you. >> i will say this. i was surprised to hear how warm the water actually is. i expected it to be much colder so good news for her. >> reporter: yeah. absolutely. it's quite warm out here as well. that's the good news if any. >> we'll check back in with you

again. thank you. >> this morning san francisco police are responding to angry questions about why they shot and killed a 19-year-old wanted parolee in the bay view district. that sound you heard, those are gun shots recorded by police shots spotting technology. police say ken harding fired at them when they tried to question him. police say the shot spotter proves that harding shot at officers first, activists say it doesn't prove anything. >> the gps is showing flash. we don't know what flash. it could be the ten bullets that were fired at him. we still don't know. until we see a ballistic report. >> activists say they are disturbed by cell phone video show police standing by harding as he bleeds on the street. there is also youtube video that shows a passerby picking up a gun at the scene as an angry

crowd grows. police say they now have that gun but they are still looking for a phone and shell casings taken from the scene. >> san leandro police officer facing drug charges is leaving the force. jason frederickson resigned friday after he was charged with giving a pound of marijuana to a confidential informant with whom he was having an affair. the 38-year-old has since pleaded not guilty and is free on bail. prosecutors have not said where he got the drugs. frederickson worked recently as a narcotics detective in his nine years with that department. >> on the heels of thousands of layoff notices at cisco, good news about job growth in silicon valley. bob is live in san jose with a new report that has a positive outlook. good morning, bob. >> reporter: good morning to you, marla. yes, while san jose's largest private employer is getting ready to lay off thousands of its employees, you've got

hundreds of other firms in the valley saying that they are expecting to add a lot more people. a new survey released overnight expect as 15% jump in high tech job hiring over the next two years. this is according to nova, a nonprofit work force training group. they came up with this conclusion after interviewing about 50 executives and surveying about 250 companies. many of these new jobs will be in engineering and require what the employers are saying advanced training and high level skills. that right there could present a dilemma. some companies question there are enough in the valley with that level of know-how when you consider this country's education system has not been producing the numbers of bachelor, masters and ph.d. candidates necessary to fulfill the demand. that could lead to a talent gap which could cut into the competitive edge that silicon valley enjoyed.

back to sis co. announcing yesterday they will be shedding 6500 employees. the networking equipment make ser trying to cut expenses in response to slower sales and increased competition from companies like hp and juniper networks. about a third are taking voluntary buy-outs t remaining would be laid off. the employees here will be notified sometime in aulg. though cisco is head quartered in san jose they have all over the world. so that's the latest here in san jose. i'm bob redell, today in the bay. >> thank you, bob. a san francisco telling us how drastic court cuts will be. the state cut $350 million from courts and the system has tapped out its emergency fund. as a result more than 40% of the staff at san francisco's superior court will lose their jobs in september. 25 of the 63 county court rooms

will close. it will take hours just to pay a simple traffic ticket and is possible only criminal cases will go to trial. >> good morning, it's now 6:10. we'll check win christina loren with a look at your pleasant forecast. >> good morning. yes, it is so pleasant. we're talking about how our weather has been the envy of the nation. over the past few weeks, well, that's going to continue. tomorrow as we warm up about 10 degrees it's not going to be oppressively hot. only about 95 in the hottest spots across the bay. we have a foggy start. take it easy. we have reduced visibilities. also starting to notice a drop-off in napa. san francisco, not really impacting you at the surface. we have low clouds hanging out over the bridges. 10 miles of visibility in livermore. oakland 10 miles right now. and you can see here one mile of visibility in santa rosa. throughout the morning because we have such a shallow marine

layer and light winds out there and high pressure building in we're not going to have to deal with the cloud cover for as long. the sun will be out, you'll get your vitamin d, by noon a thin veil of clouds. then by 4:00 p.m., 68 degrees, breezy conditions but comfortable day in the city. even better tomorrow as we warm up into the upper 70s. almost 80 degrees tomorrow in oakland and san francisco. 74 today in redwood city. 82 degrees in san jose. we have a giants game in town. of course they are taking on our rivals the dodgers. 62 degrees at 7:00 p.m. one of the thousands heading to at&t park bring a jacket. it's going to be chilly with the windchill factor. let's find out what you're dealing with on your windshield. as you head out anything to get in the way this morning? >> you know that fog and the mist might be a factor through the north bay. but this issue for the east bay, that's a problem as you come up toward 90 and the coliseum.

the view from the coliseum and the flashing lights. your two middle lanes, the ones that are open. the two side lanes t center divide an accident blocking the fast lane. other cars blocking the slow lanes. the two lanes folks are funneling through. approaching from 238, you get a better view off of 238 automatic of the castro valley y, off 580 you can use 580 as your alternate up through oakland but you have to figure out how you cut over to 880 because it's not smoothest drive about this time of morning. the rest of the maze approaching the toll plaza moving. the volume picks up in the east bay we're watching that oakland commute. >> good thing you are hear to tell people about. what would you do without mike. >> probably sleep in. >> 6:12. still to come, new snag with a

>> we have breaking news. good news to report. we've been talking about the missing 62-year-old wind surfer. we're going to head out live to christie smith. she's at yorba buena island with a rescue. >> reporter: this is great news. you know they had been looking for her since yesterday. in the last minutes the coast guard came out and told us that the 62-year-old wind surfer out of los altos has been found. and she is okay. here with me this morning is levi reed with the coast guard. what happened? >> this morning or one of our coast guard helicopters from air station san francisco 6502 was flying near the san mateo

bridge, the rescue swimmer just lowered down and checked on her and found her. we don't know exactly the details on what happened on how we spotted her, whether she was waving her arms or whatever. but we went down there, found her in good condition, and picked her up and we'll takeler to get further evaluation. make sure she's okay. >> great. that's i think what the ending that everyone wanted. thank you very much for talking with us. he's telling us that the temperature in the water out there was about 70 degrees so that certainly helped. conditions out there very difficult, they say, so of course they had to use the helicopter but the good news is she has been found and she is safe. so that's the latest from here reporting live on yorba buena island, christie smith. back to you. >> that's great news. she had been missing more than 12 hours so great news there. 6:16. as promised some bay area cities have filed suit against the california government asking the state supreme court to reinstate their redevelopment money. san jose and union city top this

lawsuit list. they say the state's two recent laws that take money away from redevelopment agencies are unconstitutional because they vie 0 late prop 22. voters passed that law to prevent the state from raiding local coffers including redevelopment agencies. brentwood and oakland have filed declarations in support of the lawsuit. >> "national geographic" releasing its list of america's best board walks. guess what, a local beach made the cut. the santa cruz beach board walk is number seven on the list. "national geographic" cites the giant roller coaster, the carousel and the boardwalk's free summer concerts as key highlights. the top five include the atlantic city boardwalk in new jersey, 2, coney island in brooklyn. you know it as the home of the

nathan's hot dog eating contest. myrtle beach, south carolina, ocean city boardwalk in maryland, and rounding out the top five, ocean front walk in venice beach, california. >> a principal accused of molesting children, possibly over a stretch of 15 years. now that sacramento county private elementary and preschool is now closed. brian hickey is live in citrus heights with the details. good morning, brian. >> reporter: that's right. good morning to you. the school remains closed. the school called creative pron fears, it's a preschool and elementary school. it has been here 27 years. yesterday the police stormed in and closed the school investigating the owner and principal robert adams known as mr. bob here on the campus, for apparent 10 cases of child molestation over 15 years. all of this under investigation.

but they are looking into all of this. they have taken it seriously, we volked the school's business license and preschool license pending this investigation. the families are simply stunned. the family of mr. adams saying there is a disgruntled former family of the school that is behind all of this. the p.d. taking this seriously. again, all of this under investigation we're told there is an office administrator also listed in the complaint for not reporting some of these allegations. mr. adams has not been arrested and there is not an arrest warrant yet. but the investigation is ongoing and the police department urging other parents that might have concerns to come forward. back to you. >> thank you, brian. 6:19. we're going to turn it over to meteorologist christine lorn. >> we're starting you without a live look at san jose. though you cannot see it we have

mostly cloudy conditions overhead. as the cloud cover you can kind of see it. it looked kind of gray. that cloud cover that's keeping things nice and mild. so as we head throughout the morning hours our temperatures are going to be more mild to start you out. you can see that from your current map. 63 in sunnyvale and san jose. versus 57 up in napa. so as we head throughout the morning it's comfortable already, great for a jog. we have good air quality. much of the nation dealing with this really, really oppressive heat wave. that will be the case today once again. we're in low pressure and a significant dip in the jet stream has kept things cool here. it's going to be a gorgeous day for outdoor activities and also on shore flow has kept our air quality nice and clean. so good air quality. breathe it in as you do your outdoor activities. it's going to warm up tomorrow and thursday, putting the 90s back on the map inland. 68 for today in san francisco, 70 in redwood city and 70

>> it's 6:24 f. your drive takes you through oakland you'll want to leave early. fast coliseum there is an accident still in the clearing, still trying to clear the lanes as you come up past 98. look at the map, slow from 238 off the castro valley merge up to the coliseum. 580 is a good alternate if you're in a car but not if you're in a big rig. big rigs not allowed because traffic is moving, you approach

the scene, you can see a different traffic flow than we saw about 10 minutes ago. the two fast lanes, maybe three might be opening at the scene. we have the slow lane blocked. you see all of the flashing lights on the shoulder and they moved the car from the center divide. the southbound side showing some slowdown at the scene. you're moving so watch for the lights approaching from both directions. the southbound side at speed passing the coliseum. a look at the san mateo bridge. some may use 580. others across the bay into the city. as we expect to see slowing off of 880 as that might see more traffic heading south of the coliseum over across the bay by this route today. >> 6:25. england transfixed as some of its top police officers, politicians and even rupert murdoch face questions by parliament. >> good morning. we have live pictures out of

london at a parliamentary hearing. you see them some member of parliament answering the questions as members of the parliament sit around that horse shoe-shaped table. rupert murdoch and rebekah brooks spotted heading in. they will face sufficient questions about what they knew and when as news corp. reporters allegedly hacked into cell phone voice mails belonging to murder victims, even soldiers who died in afghanistan and iraq. here is a weird silicon valley twist. the same guy who resigned as a board member of hewlett-packard after hp was caught hacking into phones is on the board of news corp. tom perkins one of the richest in the world stepped down. but he fully supports news corp. he says murdock couldn't

meteorologist christina loren is here now with a look at your hour by hour forecast. good morning. >> good morning to you. you saw those clouds over the south bay. they are keeping you more mild this morning. you're in the mid-60s in spots. gilroy 63, 62 in san jose and 63 degrees in sunnyvale versus 59 in hayward. and you know when you adjust that thermostat in the house a couple degrees makes a big difference. we'll let you know about a 10-degree increase as we head through tomorrow and what's in store for the weekend. let's get to you work on time. mike has been busy. >>that's right. you're going to be busy if you are heading through oakland. 98, traffic is stacked up right now. let me show you the similar live shot. traffic with the headlights going past two of the lanes that are closed. a sigalert has been issued. they expect another half hour as they clear the cars. an injury accident, one car in the center, now both on the shoulder. there is a lot of paperwork and

a lot of slowing. you see it slows from 238 out of san leandro, below 10 miles an hour in that stretch. big rigs reportedly not allowed on that portion of the freeway so they will be stuck in that backup. >> thank you, mike. 6:32. breaking news t u.s. coast guard found a 62-year-old wind surfer missing since last night. christie smith is live at yorba buena island with the good news for us. good morning. >> reporter: it's great news. it doesn't get better than this. 62-year-old kathy katan has been found safe and sound on the north side of the san mateo bridge. crews had been searching throughout the night. the coast guard had a 41-foot boat, a helicopter, they happened to be flying around near the shoreline and they

found her. about wind surfer was on her board. missing since yesterday after 5:30, she had a number of factors on her side. >> there's a lot of things that could have led to the rescue. the warm water was probably a huge help. the calm seas probably a big help and the visibility has been great for the search. and having a lot of assets out there probably helped a lot too. >> reporter: we have a live picture out of the foster city area where she went missing. we're told she's in stable condition this morning and doing quite well. she is going to be taken to a hospital to be evaluated as a precaution. she is experienced. was wearing all of the right things. she had a wet suit and radio but they don't know if that played a role in her rescue. again, this is great news. she is safe and sound after a very probably very long night on the water. that's the latest.

christie smith. now back to you. >> talk about a tough lady. >> reporter: absolutely. you know, they say she knew what she was doing. this was an area she frequented so i think she just had a number of factors that played out well for her. >> we're happy it all worked out. thank you. 6:34. the family of a bay area fisherman is asking the coast guard to pull a sunken ship from the waters off baja, mexico so they can know what happened to him. sevenmen are misching after the sinking boat sank in the sea of cortez on july 3 carrying more than 40 people in a six-day fishing trip. 35 passenger and crew members were rescued. the coast guard and the mexican navy ended a 9-day search. family and friends are working to raise funds for a private dive team if their request is conditioned.

6:34. a bright spot for job seekers, a report suggests there will be a lot of new jobs opening up in silicon valley over two years. bob has the specifics live from san jose. good morning. >> reporter: yes. you have that optimistic report you were mentioning, then the news out of cisco over to past 24 hour there is seems to be what appears to be conflicting reports on the jobs here. cisco system has just announced it will shut 6500 employees. that's 9 percent of its work force. it's trying to cut expenses in response to slower sales. about a third of those employees are voluntary buy-outs, the remainder two-thirds will be laid off. even though cisco is head quartered here, the company does have locations all over the

world so not all of the lay offs will be from here. while this huge company is cutting other firms are expecting to take on a lot of new people a. new survey expect as 15% jump in new high tech job hiring. this is from nova, the head of this study. they game to conclusion after interviewing about 50 executives. many of these new jobs will be in engineering and require advanced training and high level skills. that could prevent a problem. some companies question if there are enough in the value with that level of know how when you take into consideration that this country's education system is not churning out what they believe is an adequate number of ph.d. and masters candidate. if you have that gap perhaps sill i gone valley can lose its competitive edge.

using ultra violet waves to treat the water before it reaches your faucet. the uv plant is the largest in california. massive light bulbs -- a new government regulation requiring two separate forms of decontamination made it necessary to construct the project. good morning. it's 6:38. time to get a check on the forecast with christina loren. >> it's going to be another beautiful day, we've had about ten days now of temperatures below their seasonal averages. as we head through the next couple of days, high pressure is going to warm us up. a very short-lived warm-up. 90s inland wednesday and thursday f you are putting off the outdoor plans, we do have significant fog especially in the north bay as low pressure sits to our north.

you remember last week it kind of sat here and spun for probably about with six days. as a result of that stationary area of low pressure, we had really nice weather, consistent on shore flow and good air qualls. high pressure is building in so we expect a warm-up as we head through the next couple of days, a 10-degree jump between today and tomorrow. in san jose, 10 miles visibility, same for livermore, oakland and san francisco. still dealing with about a mile of visibility in spots of santa low is a. pretty deep pockets of fog. take it easy. 59 in livermore. by noon 79 degrees. we're going to found out the day in mid-80s. i've got that seven-day outlook ready to go. that tells a better story after we get through the two warm days, coming up. let's get you to work. are we dealing with that issue in oakland? >> definitely. look at this slow from before you get to san leandro.

diagnosed with diabetes, 8% in the san francisco area and the bay area and now there is a new drug that for the first time blocks the kidneys from absorbing glucose. it could be a life changer for the millions ever people. however, the fda today is taking a close look at what the drug long name here. the reason they are looking so closely at this drug is because it's also been linked to cancer in trials before today's fda meeting, nine people developed breast cancer, another nine developed bladder cancer compared to only one for those people who were not on the drug in those trials. a big difference. so tfda wants to know are they linked. the manufacturer says likely not because some of them happen so early in the trial they may not have been related to the drug at all. they will look at the science, make some recommendations, then the fda, the full fda, will make a decision whether or not this

drug will be available on the u.s. market in coming weeks and months. >> tracie, thank you. 6:44. we're going back to the breaking news, following all morning long good news, in fact. 62-year-old wind surfer from los altos missing for about 13 hours now. has been found rescued near the san mateo bridge. a live with us now is the battalion chief nick weber with the foster city fire department. you're in foster city on the coastline. how did they actually find her? >> well, this morning at first light the helicopter was searching its grid patterns and they were able to locate the victim floating directly behind me in front of the san mateo bridge. >> we're having a little bit of a hard time hearing you. we're going to work with this. what kind of a condition was she in? >> she was conscious, alert, in

very extreme hypothermia because she's been out all night floating in the cold water. the water is about low 50 degrees. but she did have a wet suit and that gave her surviveability. >> earlier the u.s. coast guard was telling us that the waters were in fact warmer than that. in the 60s and even the 70s. i thought that was a little warm. i was thinking more along the lines of what you're saying in the low 50s. so severe case of hypothermia. where is she heading? >> they are taking her to san francisco airport where the helicopter, coast guard helicopter, has its base and they are meeting a transport ambulance there and probably going to go off to the hospital from there. what hapt i don't know at this time. >> you have interaction with her? what kind of a mood was she in? >> i didn't actually talk to her. we were shore-based here and they were able to find her via

we're almost at the end of july now. record breaking heat, they are seeing the summer from the midsection of the nation from texas up through the midwest, record breaking sweltering heat. they have to deal with the humidity. coming up from the gulf of mexico. we've had gorgeous days, cool weather provided by a significant dip in the jet stream. high pressure is going to build in as we head through the next couple of days. the low-pressure system to the north, though, providing some foggy conditions up in the north bay so take it easy in santa rosa and napa. a few fog pockets could slow you down. high pressure moves in tomorrow. rapidly we're going to see our temperatures climb once the sun comes out. mostly sunny conditions. we're not going to have to deal with as much stratus cloud cover. as a result we'll hit mid-90s inland and the coastal areas tomorrow we're talking about the upper 70s. a gorgeous day. plan the outdoor activities, call your friends, make lunch plans. for today, another gorgeous day even inland. mid 80s.

83 in concord, 83 in livermore and 82 degrees in san jose. so if you're looking for nice weather today you're going to find it inland. tonight at the game chilly, bring a blanket or a jacket. it tends to get a little cold in at&t park when we see the winds blowing in and they will be rather strong, 5 to 15-mile-per-hour breezes. 60 degrees at 8:00 p.m. at at&t park. bring the jacket. 9:00 p.m., 59 degrees, cool as you make your way home. you'll probably deal with cloud cover at that time as well. it won't last long. we're going to lose it by about 9:00 a.m. tomorrow. and that means we'll be able to climb to 94 degrees. that's your daytime high in places like livermore and concord. 96 on thursday. then we cool off, a trough dips in, in time for the weekend. 83, 80 on saturday and comfortable weather continues to the beginning of next week. then it starts to warm up. we'll continue to update you on this ever changing forecast each

altamont pass to the dublin interchange. the south bay, that slowdown kicked off for 101. sigalert canceled. >> construction is under way in a trail that bypasses metallica lead singer james headfield's property. he put up this fence near his san rafael home. he said that people who use the trail were trashing his property. marin county drew up a plan to reconnect the preserves with a new trail. it's costing the county about $650,000. construction should be finished in september. the county told the marin independent journal headfield has been helpful with the project. he allows workers to use his roads to get to the site. >> four peninsula cities are banding together to save money. the plan is to combine the millbrae and san bruno fire departments with the central county fire department which already serves burlingame and

hillsborough. all four councils approved the merger. it could save the four cities hundreds ever thousands apiece. the consolidation will close two fire stations. one new station will open. >> america's second largest book store chain is closing maybe in a week. borders is going into liquidation. it closed about 200 stores when it filed for chapter 11 in february. it announced yesterday it will close the rest of the 399 stores. borders says competition from on line retailers such as amazon and ereaders choked their ability to compete. >> six stores will close in the bay area. here is a list of those along with a store in vacaville. nationally the closings mean that almost 11,000 will lose their jobs. >> he's going to talk about
